The Gold Medal Mom™ Contest
Official Contest Rules
No Purchase Necessary to Enter or Win.
Eligibility: Contest open to "Nominators" (person who submits an entry) and "Nominees" (subject matter of the submitted entry) who are legal residents of the 50 United States or the District of Columbia and who have reached the age of majority in their home state (and are at least 18) as of 1/18/08. The Nominee must also be someone with whom the Nominator is personally acquainted, and Nominator must have Nominee's permission to nominate him/her. Employees, officers, directors, and agents of Tyson Foods, Inc. ("Sponsor"), Arnold Worldwide, CJRW, GolinHarris, Project Support Team, Inc. ("P/S/T") and each of their respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, and advertising/promotion agencies (collectively, "Released Parties"), and the immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in the same household of each, whether or not related, are not eligible to participate or win prizes. Void where restricted, taxed or prohibited by law. All applicable federal, state and local laws and regulations apply.
How to Participate: There are two ways to participate: 1) Online: a) Visit goldmedalmom.com between 12:00:01AM Eastern Time ("ET") on 1/22/08 and 11:59:59PM ET on 3/31/08; b) Complete and submit the online registration form according to the instructions provided; c) either: i.) Submit an essay of (1,250) characters or less (counting all characters, including spaces, numbers, punctuation, etc.) and a photo responding to the Contest topic ("Contest Topic"): "What Makes the Mom You're Nominating America's Gold Medal Mom™?"; or ii.) Submit an essay of (1,250) characters or less and a video of no more than one (1) minute responding to the Contest Topic; and d) Click the "Submit" button; or 2) On-Site: a) Attend select Tyson sponsored events between 1/18/08 and 3/31/08 ("Promotion Period") (For a list a participating events visit goldmedalmom.com) b) Visit the video Kiosk; c) Record a video (using the equipment provided) of no more than one (1) minute responding to the topic: "What Makes the Mom You're Nominating America's Gold Medal Mom™?"; and d) Click the "Submit" button. Limit one (1) entry per person, per valid e-mail address and per household, regardless of method of entry. Additional entries received from any person, e-mail address or household thereafter will be void. Third parties, footage, music and/or other material subject to third party rights prohibited. Photo must be uploaded as a .jpeg or .gif file not exceeding 4MB. If the original digital photograph was saved at a lower resolution and attached to the Official Online Entry Form, save the original high resolution for potential future use by Sponsor and its designees. Video file size cannot exceed 100MB and must be submitted in one of the following formats: .wmv, .mpg, .mpeg, or .mov. To be eligible, essay and photo, essay and video submission, or video submission (collectively, "entry") cannot have been previously published or submitted in any previous or current competition, contest and must be: complete; in English or Spanish; true and verifiable; be in keeping with Sponsor's image; and must be your original creation. Modification of an existing work does not qualify as original. You may nominate yourself. Entry cannot defame or invade publicity and/or intellectual property rights or the privacy of any person, living or deceased, or otherwise infringe upon any copyrighted, trademarked, or patented works or person's personal or proprietary rights. In the event of non-compliance with any requirements specified herein, entry will be void. Entries generated by script, macro or other automated means or deemed by the judges, in their sole discretion, to be immoral, obscene, profane or not in keeping with Sponsor's image or in violation of these Official Rules will be void. Your submission of an entry constitutes your representation of eligibility, consent to participate in Contest and consent for Sponsor to obtain, use, and transfer your name, address and other information for the purpose of Contest administration. Released Parties are not responsible for lost, incomplete, late, stolen, garbled, delayed, illegible, unintelligible, inaccurate or misdirected entries, essays, videos, photographs, submissions, or votes; theft, destruction or unauthorized access to, or alteration of, entries or votes; or failures or malfunctions of phones, phone lines or telephone systems; interrupted or unavailable network, server or other connections; any error, omission, interruption, defect or delay in any transmission or communication; human-processing error; traffic congestion on the Internet or any technical problem, including but not limited to any injury or damage to entrant's or any other person's computer related to or resulting from Contest participation; errors or omissions in these Official Rules, in any Contest-related advertisements or other materials, in the selection or announcement of winners or in awarding of prize or the tabulating of votes; or other problems or errors of any kind whether mechanical, human, electronic or otherwise relating to or in connection with the Contest, including any problems or errors which may occur in connection with the administration of the Contest or with the recording of videos at any kiosk or the cancellation of any select Tyson sponsored event. Sponsor reserves the right to void any and all entries of an entrant who Sponsor believes has attempted to tamper with, influence, or impair the administration, security, fairness, judging or proper play of Contest and such entrant will be disqualified. All entries become property of Sponsor and will not be returned. Neither Sponsor, nor anyone acting on its behalf, will enter into communications with any Nominator or Nominee regarding Contest other than to notify potential Finalists and Grand Prize winner. Sponsor reserves the right in its sole discretion to post all approved submissions on goldmedalmom.com for public viewing.
Judging: Winner determination for this Contest will occur in two phases. Finalist Determination: Based on the following criteria, a panel of qualified independent judges will select twenty-five (25) Finalist Nominees on or about 4/11/08 from among all eligible entries received. Finalists shall be deemed the selected Nominee, rather than the Nominator who submitted the Entry and prize shall be awarded to the Nominee and not the Nominator, unless Nominee and Nominator are the same individual. Judging will be supervised by P/S/T, an independent judging organization whose decisions will be final and binding in all matters relating to this Contest: 1) Presentation of Story, including compelling delivery, expression, appeal, and overall engagement: 0-30 points; 2) Level of Emotion: 0-20 points; 3) Originality, including creativity, depiction, and uniqueness: 0-20 points; 4) Quality, including essay structure, grammar, video execution, editing, and sound and/or quality of photo: 0-15 points; and 5) Relevance to Contest Topic: 0-15 points. The twenty-five (25) Nominees with the highest total scores based on above judging procedure will be declared Finalists (subject to verification of eligibility and compliance with the terms of these Official Rules). In the event of a tie, entrant from among those tied with the highest score in Presentation of Story will be declared a potential Finalist. If a tie still exists, from among remaining pool of tied entrants, entrant with highest score in Originality, Quality, and then in Relevance to Theme (if and as necessary to break tie), will be declared the potential Finalist. Sponsor reserves the right to select fewer than twenty-five (25) Finalists if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Finalists. Potential Finalists and their respective Nominators will be notified by P/S/T by telephone and/or overnight courier. If any potential Finalist or Nominator cannot be contacted within five (5) business days, does not return a phone call or correspondence from P/S/T within twenty-four (24) hours following attempted notification, or fails to comply with verification process and/or eligibility requirements, that potential Finalist may be disqualified. Additionally, all twenty-five (25) potential Finalist Nominees and their respective Nominators will be required to execute and return an Affidavit of Eligibility, Liability and (where legal) Publicity Release within five (5) days of date of issuance of notification. Noncompliance with the foregoing may result in disqualification and the identification of a runner-up Finalist, at Sponsor's discretion and time permitting. Grand Prize Determination: One (1) Grand Prize winner will be selected from the twenty-five (25) Finalist entries. Finalist entries will be re-judged based on the following: 1) Presentation of Story, including compelling delivery, expression, appeal, and overall engagement: 0-30 points; 2) Level of Emotion: 0-20 points; 3) Originality, including creativity, depiction, and uniqueness: 0-20 points; 4) Quality, including essay structure and grammar, video execution, editing, and sound and/or quality of photo: 0-10 points; 5) Relevance to Theme: 0-10 points and 6) Peer Vote (defined below): 0-10 points. The Finalist entry with the highest total score will be declared the potential Grand Prize winner. In the event of a tie, the tiebreaker procedure outlined above will be followed to determine the potential Grand Prize winner. Peer voting on the Finalist Nominees: Between 12:00:01AM ET on 5/11/08 and 11:59:59PM on 6/11/08 (the "Voting Period"), Finalist entries will be posted on goldmedalmom.com for public vote. To vote for the Finalist whom you believe best exemplifies the Contest Topic: 1) Visit goldmedalmom.com during the Voting Period; 2) Select the entry that you believe best exemplifies the Contest Topic; and 3.) Click the "Submit" button. Limit one (1) vote per person or e-mail address for the entire Peer Voting Period. Multiple votes received from any person or email address or generated by script, macro or other automated means or with the intent to affect the integrity of the peer voting process may, at Sponsor's discretion, be voided. Potential Grand Prize winner will be determined on or about 6/18/08 and will be notified by P/S/T by telephone and/or overnight courier. If Sponsor is unable to contact potential Grand Prize winner within a five (5) business day period, mailed notification is returned as undeliverable, or Grand Prize winner is not in compliance with these Official Rules, he/she may be disqualified and, at Sponsor's discretion and time permitting, a runner-up may be selected. Grand Prize winner's traveling companion must be of legal age of majority in his/her state of residence (and at least 18) unless a legal ward or child of Grand Prize winner. Grand Prize winner's traveling companion (or if a minor child or legal ward, Grand Prize winner) will be required to sign and return a Liability Release and (where legal) Publicity Release prior to the issuance of travel documents.
Prizes: One (1) Grand Prize: Trip for Grand Prize winner and one (1) guest to Beijing, China for the 2008 Olympic Games from August 13, 2008 through August 17, 2008. Trip consists of: A) round trip coach air transportation from major U.S. international gateway airport nearest winner's residence to Beijing, China; B) Four (4) nights standard double occupancy hotel accommodations (one (1) room); C) Two (2) tickets to each of four (4) 2008 Olympic Games Events designated by Sponsor; D) Breakfast daily for four (4) days, two (2) Lunches (determined by Sponsor), and two (2) Dinners (determined by Sponsor); E) Ground Transportation to/from the designated 2008 Olympic Games Events; F) Onsite Program Manager, Assistant Program Manager and bilingual host to accompany guests; and G) $6,000 awarded in the form of a check. (ARV=$36,000). Actual prize value will vary depending on winner's city of departure. Grand Prize trip must be taken on dates designated above by Sponsor or prize will be forfeited in its entirety and, at Sponsor's discretion and time permitting, awarded to an alternate winner. Travel and hotel accommodation restrictions as well as other travel restrictions may apply. Grand Prize winner and his/her respective guest must travel together on same itinerary, which must be booked through Sponsor's agency on a carrier of Sponsor's choice and is at Sponsor's sole discretion. If a designated 2008 Olympic Summer Games event(s) is canceled or postponed for any reason, travel prize will be awarded less affected event tickets, which will be substituted with items of comparable or equal value as available and determined by Sponsor. Fees, federal and state taxes, additional meals and ground transportation, gratuities, insurance and any other costs and expenses associated with the acceptance and use of the prize not specifically stated herein as being awarded are the sole responsibility of the winner. Grand Prize winner and his/her guest are responsible for obtaining any required travel documents, including valid passport and visa (as applicable). Event tickets may change and are subject to certain terms and conditions as specified by issuer. Seat locations will be determined by Sponsor. Grand Prize winner and guest must agree to comply with all applicable stadium/arena rules and regulations. Failure to do so may result in forfeiture of ticket portion of prize package. Released Parties are not responsible for travel delays or cancellations. Twenty Five (25) Finalists Nominee Prizes: $300 spafinder.com Gift Card (ARV=$300). Gift Cards subject to certain terms and conditions as specified by issuer. Restrictions may apply. All prize details are at Sponsor's sole discretion. Total ARV of all prizes: $43,500.
Miscellaneous: No transfer, cash redemption, assignment, or substitution of prize, or portion thereof, except by Sponsor who may substitute prize, or portion thereof, with one of comparable or equal value, at its sole discretion. By entering, each Nominator warrants and represents that his/her Entry submitted does not defame or otherwise violate the rights of any third party and does not violate any federal, state or local laws or ordinances. Nominators further warrant and represent that (1) they have secured the requisite consent from the Nominee referenced in their Entry and, if their Entry is a winner, agree to provide legal releases for the use of such reference in a form satisfactory to judges; (2) that Sponsor shall own the Entries (and all material embodied therein) and will not be acknowledged or returned; and (3) that by entering, the Nominator irrevocably assigns to Sponsor and its designees any and all rights, title and interest in the Entry including but not limited to all intellectual property rights; and (4) that Sponsor and its designees shall have, without limitation, the perpetual right worldwide to edit, adapt, modify, publish, exploit and use the Entries in any way and in any and all media for trade, advertising, promotional, public relations and/or other purposes as Sponsor and/or its designees may determine without further permission from, or notification or consideration to Nominators, Nominees, or any third parties. Nominators and Nominees further agree (1) to abide by these Official Rules and the decisions of the Sponsor and judges which shall be final and binding; (2) that Sponsor and its designees shall have the right and permission to use (unless prohibited by law) Nominator's and Nominee's name, voice, appearance, image, city and state of residence, photograph and/or likeness for advertising and/or promotional and/or public relations and/or trade and/or any other purpose in any and all media now or hereafter known throughout the world in perpetuity without further compensation, permission or notification to Nominators, Nominees or any third parties; and (3) that the Released Parties shall have no liability and will be held harmless by Nominators and Nominees for any liability, loss, injury or damage to participants or any other person or entity, including personal injury or death to participants or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of Nominator's or Nominee's participation in this Contest, the use of any Entry, the acceptance and use of the prize (including any travel or activity related thereto) or any of the rights granted herein. Sponsor reserves the right, in its sole discretion, to modify, terminate or suspend Contest should any non-authorized intervention or causes (including but not limited to threats of terrorist activity, inability to secure any prize component, labor strikes, and/or acts of God) corrupt or impair the administration, security, fairness, judging, or proper play of Contest and, if Contest is terminated, award prize from among all non-suspect, eligible Entries received prior to suspect event requiring such termination using the judging procedure specified above.
